KENYA MEDICAL ASSOCIATION RAISE CONCERNS OVER THE ELECTRONIC TAX INVOICE MANAGEMENT (eTIMS) BY KRA.

The Kenya Medical Association (KMA) has revealed plans to head to court to challenge introduction of electronic tax invoice management systems in the health sector by the Kenya Revenue Authority (KRA).

KMA, which has vowed to file a petition this week, has called on KRA to immediately withdraw the Electronic Tax Invoice Management System eTIMS which was introduced through the Finance Act, 2023.
KMA officials addressing the press in a press briefing at KMA head quarters Nairobi.

The doctors have raised concerns that the system might compromise patient confidentiality, data privacy and security which will arise from giving external access to a third party and having to provide sensitive information through medical services invoices.

“The eTIMS system is a breach of confidentiality, once you put information, it doesn't matter what the data is, that information is traceable to the patient.” said Dr. Simon King'ondu president KMA.

The president also noted that KRA's intention is to introduce a VAT system on a non-VAT system where doctors will be required to pay their taxes before being paid their salaries.

“The eTIMS system is an invoicing system, we as doctors already pay taxes. Kenya Revenue Authority already have visibility of tax using withholding certificate of taxation. They have not tested credit systems on the E-tims.” Said Dr. King'ondu.

The medics led by the association's president Dr. Simon Kingondu and CEO Dr. Brenda Obondo noted that the move will also hinder diplomatic relations since doctors serve foreigners living locally who will protest their data being put on the said system.

Dr. King'ondu announced that on Tuesday the association will ask the medical doctors for the way forward and also ask them to stop providing their services both the private and public hospitals.

The association has taken legal action against the eTIMS on the basis of confidentiality and doctors paying taxes before receiving their salaries. The case will be present to court before the end it the week.
